These Terms & Conditions (“Terms”) constitute a legally binding agreement between you and Dr. Ben Shomer (“Company,” “we,” “us,” or “our”) concerning your access to and use of our websites, applications, services, programs, courses, memberships, and related offerings (collectively, the “Services”). By accessing or using the Services, you confirm that you have read, understood, and agreed to be bound by these Terms.
If you do not agree, you must not use the Services.
We provide education and mentoring services, including live and recorded sessions, courses, programs, and memberships delivered online (and occasionally in person). We do not provide medical care, diagnosis, treatment, or legal/financial advice.
Regulatory scope. The Services are not intended to comply with medical-specific regulations or standards. Do not rely on the Services as a substitute for professional medical advice. Always consult a qualified healthcare provider for personal medical concerns.
Unless otherwise indicated, the Services and all content, source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Services (collectively, “Content”) are owned or licensed by us and are protected by copyright, trademark, and other laws. No rights are granted to you other than those expressly stated in these Terms.
You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, noncommercial purposes. Any reproduction, distribution, modification, or derivative use of the Content is prohibited without our prior written consent.
By using the Services, you represent and warrant that: (a) you have legal capacity and agree to comply with these Terms; (b) you are not a minor in your jurisdiction, or you have parental permission; (c) your use will not violate any applicable law or regulation.
By making a purchase, you agree to provide current, complete, and accurate account and payment information. You authorize us to charge your selected payment method for any purchases and any applicable taxes.
Currency. Prices are displayed in U.S. dollars (USD). Payments may be processed by third-party providers in USD or other supported currencies, as specified at checkout.
Billing providers. We may use third-party processors (e.g., PayPal or other gateways). Your use of such processors is subject to their terms and policies.
We reserve the right to refuse any order placed with us and to correct errors or inaccuracies in pricing or product descriptions at any time.
Except as required by law or expressly stated in a specific offer, purchases are non-refundable. Any discretionary refunds are at our sole discretion.
Cancellation of a transaction shall be in accordance with the Consumer Protection (Cancellation of a Transaction) Regulations, 2010, and the Consumer Protection Law, 1981.
In accordance with these laws, customers are entitled to cancel a purchase of a service within 14 days of the transaction date, provided that the cancellation is made at least two business days before the first scheduled session or service begins.
For ongoing or recurring services — such as courses, programs, or memberships — cancellation after the first session has begun will apply only to future sessions that have not yet taken place, and any refund will be calculated accordingly.
Refunds, when applicable, will be issued in accordance with the law and may be subject to lawful deductions (such as cancellation or processing fees).
You agree not to access or use the Services for any purpose other than those for which we make the Services available. Prohibited activities include, without limitation: copying or scraping content; circumventing security features; reverse engineering; interfering with operation; using the Services for unlawful, harmful, or defamatory purposes.
If you submit comments, testimonials, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display such content in connection with the Services and our business, in accordance with applicable law and our Privacy Policy.
The Services may contain links to third-party websites or resources. We are not responsible for their content, policies, or practices. Accessing third-party sites is at your own risk.
Your use of the Services is subject to our Privacy Policy. We may process and store data on servers located outside Israel. By using the Services, you consent to such processing and storage in accordance with our Privacy Policy.
These Terms remain in effect while you use the Services. We may suspend or terminate access at any time for any violation of these Terms or applicable law. Upon termination, your right to use the Services will cease immediately.
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee results or outcomes from any course, program, or mentoring session.
To the maximum extent permitted by law, in no event shall we be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from or related to your use of the Services.
You agree to defend, indemnify, and hold us harmless from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or your breach of these Terms.
These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation are governed by the laws of the State of Israel, without regard to conflict-of-laws principles.
Any dispute arising out of or in connection with these Terms, the Services, or any related transaction shall be subject to the exclusive jurisdiction of the competent courts in Israel. You agree to submit to the personal jurisdiction of such courts and waive any objection based on forum non conveniens.
We reserve the right to change, modify, or remove the contents of the Services at any time, and to modify or discontinue all or part of the Services without notice. We will not be liable for any modification, suspension, or discontinuance of the Services.
There may be information on the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.
Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
If any provision of these Terms is held unlawful or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision shall not be deemed a waiver.
